These Terms and Conditions of Sale (hereinafter the “T&Cs”) govern the contractual relationship between:
Timmerman Expertise, a simplified joint-stock company with a single shareholder (SASU), organizer of the OPEN CALL contest, hereinafter referred to as the “Organizer”,

Any individual registering for the OPEN CALL contest and/or purchasing products or services offered by the Organizer, hereinafter referred to as the “Client” or the “Participant” when the person is registered for the contest.
These T&Cs apply to:
Any registration, payment or purchase implies full, complete and unconditional acceptance of these T&Cs as well as, where applicable, the official OPEN CALL contest rules, made available to the Client before validation of registration.

3.1 – General presentation
OPEN CALL is an artistic, educational and promotional contest designed to highlight new profiles in the fields of modeling, image, and, depending on the category, content creation.
OPEN CALL is not a modeling agency. Registration for and participation in the contest do not in any way guarantee the obtaining of a contract, representation, professional collaboration, income, specific public exposure, or a career launch.
3.2 – Services included in the registration fee
Unless otherwise stated at the time of registration, the registration fee includes:

The contest is organized, unless otherwise announced by the Organizer, in two stages:
The Organizer reserves the right to adjust the contest schedule, content, order of events, jury, categories, timetable, venue or general organization of the event, provided that such adjustments do not substantially alter the main service offered.
The detailed selection process and contest format are set out in the official contest rules.
4.1 – Registration procedure
To register, the Client must:

4.2 – Accuracy of information
The Client guarantees the accuracy, sincerity and timeliness of the information provided during registration.
Any inaccurate, incomplete or misleading statement, identity theft, or submission of falsified documents may result, at the Organizer’s discretion, in:
without prejudice to any legal action and without refund, under the conditions set out in these T&Cs.
4.3 – Age requirements and minors
The contest is open to both adults and minors, subject to any specific conditions applicable to certain categories.
Any minor participant must, no later than the day of the event:
If these conditions are not met, the Organizer may refuse the minor’s participation without incurring any liability.
4.4 – Categories
Participants may be assigned to different categories depending on their profile, including: runway, commercial, talent, curve, small, details, lingerie, senior, junior or atypical.
The Organizer shall have sole discretion regarding the category assigned to each participant, based on the participant’s profile, image and the organizational needs of the contest.
5.1 – Registration fee
The registration fee for the OPEN CALL contest is set at €49 including VAT per participant, unless a special offer or specific rate is expressly announced by the Organizer.
The applicable price is the one in force on the date payment is validated.
5.2 – Additional products and services
The Organizer may offer additional products or services for sale during or after the event, including:
The prices of such products and services are indicated in euros, all taxes included.
6.1 – Payment of registration fees
Payment of the registration fee is made online using the secure payment link sent by the Organizer after confirmation of registration.
The accepted payment methods are those offered at the time of payment, including bank card.
Payment is processed by a secure provider such as Stripe or any equivalent provider chosen by the Organizer.
Full payment definitively validates the registration and constitutes acceptance of these T&Cs as well as the official contest rules.
6.2 – Payment for additional purchases
Additional products or services may be paid for using the payment methods offered by the Organizer on-site or remotely.
An invoice or proof of purchase may be issued upon request, in accordance with applicable law.
In accordance with Article L.221-28, 12° of the French Consumer Code, the fourteen-day right of withdrawal does not apply to services relating to leisure activities to be provided on a specific date or during a specific period.
The Client expressly acknowledges that participation in the OPEN CALL contest falls within this exception, insofar as it is linked to a session organized on a specific date or during a specific period made known to the Client before payment.
Consequently, the Client does not benefit from a fourteen-day right of withdrawal for registration in the OPEN CALL contest.
This information is provided to the Client before payment.
8.1 – Cancellation or postponement by the Client
Except where otherwise required by mandatory law or expressly agreed by the Organizer, any validated and paid registration is firm and final.
In the event of inability to attend, absence, delay, withdrawal or renunciation by the Client, no refund shall be due.
However, the Organizer may, as a commercial gesture and without being under any obligation to do so, offer a postponement to another session, subject to availability and without this constituting an acquired right for the Client.
8.2 – Cancellation or postponement by the Organizer
In the event that a session is cancelled by the Organizer, in particular due to force majeure, safety constraints, venue unavailability, major technical issue, insufficient number of participants or any legitimate organizational reason, the Client may choose:
No additional compensation, indirect costs reimbursement or damages may be claimed, except where mandatory law provides otherwise.
8.3 – Delay or absence of the Client
Any significant delay or absence of the Client on the day of the event may result in the impossibility of participating in all or part of the session, without refund.
The Organizer will make its best efforts to accommodate a late Participant when materially possible, without any obligation to do so.
8.4 – Exclusion
The Organizer reserves the right to immediately exclude, without refund, any participant who:
Photographs, prints and other materials produced at the Client’s request or customized according to the Client’s choices may, where applicable, constitute goods made to the Client’s specifications or clearly personalized goods.
In such case, where the sale is concluded remotely, the Client is informed that the right of withdrawal may be excluded under the conditions provided for by the French Consumer Code.
Specific conditions applicable to such additional sales may be provided at the time of purchase.
10.1 – Recording during the event
As part of the contest, the Organizer may photograph and film participants, the audience and the event for the following purposes:

Unless a valid objection is expressed under the conditions set out below, the Participant authorizes the Organizer to use the Participant’s image, voice and silhouette captured in the context of the contest on any communication media related to OPEN CALL and the Organizer’s activities, including:
This authorization is granted for a period of five years from the date of capture, worldwide, on a non-exclusive basis and without additional remuneration other than participation in the contest and, where applicable, the services actually received.
The Organizer undertakes not to make any use that would seriously undermine the dignity, privacy or reputation of the Participant.
10.3 – Objection or restriction
An adult Participant may object, before the event, to certain promotional uses of their image by sending a written request to: contact@open-call.com.
For minor participants, any promotional use of the image is subject to authorization by the legal representative(s). A separate authorization may be requested by the Organizer.
10.4 – Photos sold to the Client
Photographs delivered or sold to the Client are intended for personal, private and non-commercial use only, unless otherwise agreed in writing.
The Client shall refrain from any commercial use, professional transfer, resale, alteration infringing the author’s rights, or misleading use without prior written authorization.
All elements relating to the OPEN CALL contest, including trademarks, logos, graphic charter, visuals, texts, videos, photographs, promotional content, comp cards, databases and communication materials, are protected by intellectual property law.
Unless prior written authorization is obtained from the Organizer or the relevant rights holders, any reproduction, representation, adaptation, distribution, exploitation or use, in whole or in part, is prohibited.
The Organizer shall use reasonable means to ensure the proper conduct of the event and the performance of the services offered.
However, the Organizer shall not be held liable in the event of:
The Client remains solely responsible for their personal belongings, behavior, travel arrangements and the compatibility of their participation with their health condition, personal obligations and constraints.

Data are intended for the Organizer’s authorized departments and, where necessary, for its technical subcontractors or service providers involved in the organization, strictly within the scope of their duties.
Data are not sold or transferred to third parties for commercial purposes without the prior consent of the person concerned.
13.5 – Retention period
Data are kept for the period necessary for the purposes for which they are collected and are then archived where required by law or where necessary for the defense of the Organizer’s rights.
Data used for commercial follow-up or prospecting are kept for a period proportionate to the relationship maintained with the Client.
13.6 – Rights of data subjects

The Client is invited to clearly explain the subject of the complaint and provide any useful supporting documents.
The Organizer will endeavor to respond within a reasonable timeframe.
In accordance with Articles L.612-1 et seq. of the French Consumer Code, any consumer Client who has first submitted a written complaint to the Organizer and has not obtained a satisfactory amicable solution may refer the matter free of charge to the consumer mediator appointed by the Organizer.
The consumer may refer the matter to this mediator under the conditions provided by the applicable legal texts.
These T&Cs are governed by French law.
In the event of a dispute, the parties shall first seek an amicable solution.
Failing an amicable agreement, the dispute shall be brought before the competent courts under the ordinary rules applicable to consumers.
The Organizer reserves the right to amend these T&Cs at any time.
However, the T&Cs applicable to a registration or purchase are those accepted by the Client on the date the order or payment is validated.
New versions of the T&Cs are published on the Organizer’s website.
If any provision of these T&Cs is declared null, invalid or unenforceable, the remaining provisions shall remain in full force and effect.
The fact that the Organizer does not invoke one of the provisions of these T&Cs at a given time shall not be interpreted as a waiver of its right to invoke it later.
These T&Cs supplement the official OPEN CALL contest rules.
In the event of inconsistency between the documents, these T&Cs shall prevail for matters relating to:
